Our client’s husband was killed while riding his motorcycle late one night on a rural road.

The husband had several life insurance policies including policies that carried double indemnity riders, doubling the coverage if killed in an accident.

The wife had been turned down for coverage because tests showed that the husband had some alcohol in his system and the carrier, therefore, claimed that the deceased was responsible and that the alcohol nullified the coverage.

We argued successfully that this was insufficient to nullify the coverage, resulting in a substantial recovery for our client.
